Note that any presence, registration of an account, or use of the application constitutes acceptance and agreement to what is stated in these terms and conditions and all other policies announced, and what is updated and published later. 1- Definitions The following terms, wherever they appear in these terms and conditions, have the meanings shown next to them, unless the context requires otherwise: – Terms and Conditions: This agreement regulates the relationship between (Business Meal) and the user, and defines the rights and obligations of both parties. - Business Meal : Business meal company for providing meals with commercial registration number 5850145297, which provides its services through the (Business Meal ) electronic platform, and its address: Abha - Al Naseem; In the Terms and Conditions, they may be referred to as “we/our” speakers. – User: the person who registers an account on the (Business Meal ) platform or who benefits from (Business Mail) services; It may also be referred to anyone who visits or browses our platform within the limits of the terms and conditions that apply to them. – Store: Any of the stores, restaurants, bakeries, hotels - and the like - that display their products on the (Business Meal ) platform. – Representative: The person who delivers the order to the user. – Platform: The Business Meal electronic application through which the user can access or benefit from Business Meal services. – Third party: any person, whether of a natural or legal capacity, public or private; It may include (Business Meal ) and its representatives, depending on the context. – Use: Benefit from any of Business Meal’s services, register or be present on its platform; The definition includes all tenses of the word's verb. – Personal data: any statement that specifically identifies the user, or makes him identifiable. – Violation: Any act or violation by the user of any clause in the terms and conditions or any text in a law, regulation, decision, contract, custom, or violation of public morals, applicable in the Kingdom of Saudi Arabia and in the country in which the user uses (Business Meal ) services. Its territory and jurisdiction, and the definition includes all verb tenses of the word. 2- Business Meal services (Business Meal ) is an electronic platform that provides a paid service that enables users to order from available and shared stores whose products and goods are displayed inside it and provides payment service and order delivery service. Therefore, Business Meal does not prepare, manufacture, provide or be involved in the products and goods displayed on its platform. 3- User terms of service The following conditions must apply to the user in order for his presence and use of Business Meal services to be legitimate: 3-1 The Business Meal user must be able to act, have full legal capacity, and be (18) years old. If the user lacks legal capacity or is less than (18) years old, his use of (Business Meal) services and the application must be with approval and under supervision. One of his parents or legal guardian, as the case may be; The leave and supervision of his or her parents or legal guardian constitutes acceptance and agreement to the user’s terms and conditions and other policies issued and updated by Business Meal. 3.2 We have not previously stopped, banned, suspended or canceled any user account. 3-3 The Business Mealshould be used for personal, not commercial, purposes. 4- Pledges 4-1 The user undertakes not to use the (Business Meal) application except in ways and for legitimate and acceptable purposes, consistent with our purpose and services, with the terms and conditions, with public morals, and with all laws, regulations and decisions issued by the country whose regulations (Business Meal) is subject to, in accordance with Clause (17) of the Terms. Terms, and the country within whose territory the user accesses our services and platform. 4.2 The user undertakes that the terms of service apply to him, and to comply with the terms and conditions and all policies of (Business Meal), and any updates thereof. 4-3 The user undertakes that all the data, information, addresses and contact numbers he enters and provides are correct and real, and that the payment methods he uses and provides are legitimate and owned by him or authorized to use and dispose of them. 4.4 The user undertakes to maintain his personal account data and his secret password, and to notify (Business Meal) immediately upon becoming aware of any unauthorized or illegal use or access - by any means - of our services, his personal account, his secret password, his name or his address. And the applicable provisions, rules, regulations, decisions and public morals, and to comply with the content standards contained in Clause (5) of the Terms and Conditions. 4-8 The user undertakes not to process, monitor, copy, extract, compile, merge, modify or change - or any other action - any information, content or data existing or accessible through the (Business Meal) platform, and not to display Or add, upload or download any illegal or unauthorized materials, and not infringe in any way on intellectual property rights, or do anything that would disrupt or affect the operation or security of the (Business Mail) platform directly or indirectly, He shall not undertake any reverse engineering, reverse assembly, disassembly, or similar computer or software operations and actions on the (Business Meal) platform for any purpose. 4-9 The user undertakes, when evaluating the services, to fulfill what is stated in Clause (13) of these terms and conditions. 4.10 The user undertakes to bear responsibility for all violations, infringements or breaches of any legal, customary or agreement - including these terms and conditions - issued or caused by him - intentionally or negligently - and to compensate for them. 5- Content standards 5.1 The user must comply with the standards of acceptable content, which apply to everything he enters, participates, receives, sends, downloads, uploads, displays - and so on, whatever its nature - on the (Business Meal) platform, and the interactive services associated with it. Throughout its use, it must be compatible with the terms, conditions, public morals, laws, regulations and decisions in force in the Kingdom of Saudi Arabia, and in any country whose regulations the user is subject to while using the (Business Meal) platform and its related services. 5.2 All inputs, contributions and contributions issued by the user must be accurate when presenting or clarifying the facts, and must be in good faith when providing opinions, suggestions or evaluations. 5.3 These entries, contributions and contributions, whatever their nature or form, must be free of the following: 5-3-1 Any words, texts, media or actions that are defamatory, obscene, offensive, racist, hateful, inflammatory, sexist, promote violence, or promote discrimination on the basis of race, gender, religion or nationality. Otherwise, the data and information registered with us will be deemed valid and legally applicable, and he must bear all the consequences or losses resulting from not updating them, including obstruction, inability, or non-delivery of the order. 6-3 The user shall bear all the consequences and losses resulting from his failure to comply with Clause (4-6) of these terms and conditions, which is related to staying connected during the use of the service until its end, including obstruction, inability, or non-delivery of the request. 6-4 The user bears all expenses, fees and losses for his orders that he cancels, refuses to receive, or we are unable to deliver due to the user, in accordance with the provisions of clause (11) of the terms and conditions. 6-5 It is the user’s responsibility to verify the quality, quality, reliability and details of the products displayed on (Business Meal) and everything related to them, by inquiring directly from the stores that provide and display their services and products to the user via the (Business Meal) platform. 6-6 The user bears responsibility for his misuse of (Business Meal) services, his violation of any of the user’s conditions, his violation of any law, regulation, decisions, customs, or public morals, or his assault on others and their rights. 6-7 The user shall bear any consequences resulting from providing, entering or registering any incorrect information. 6-8 The user bears responsibility for disclosing the information and data of his personal account in (Business Meal) to others, including providing others with his personal password, failing to save it, or enabling others to use his private account by any means, direct or indirect. 6-9 The user bears responsibility for all consequences resulting from his failure to notify us or his delay in notifying us of any illegal access to his data or his own account, as detailed in Clause (4-4) of the Terms and Conditions; The notification does not exempt him from his responsibility for any damages that occur as a result. 6-10 The user is obligated to compensate (Business Mail) for all disputes and claims that (Business Meal) may raise against the user or that may be raised against (Business Mail) by others, in the event that these disputes and claims arise and result from an error, negligence, infringement, or Violation by the user of any contract, system, regulation, decisions, customs or established customs in the country in which he resides or within whose jurisdiction these infringements and violations fall, or arising from his violation of the terms and conditions, whatever the nature of these disputes or claims; The compensation includes all expenses and fees incurred by Business Meal in confronting, settling or paying these claims, including legal costs - even if Business Meal loses - and attorney's fees. 7- Limitation of Business Meal’s liability 7.1 Business Meal does not bear responsibility for any damages, losses, or failure that occurs as a result of a delay or inability to implement the service due to any foreign cause beyond its control or the limits of its control, including - but not limited to - a cause attributed to the user, Or force majeure, bad weather conditions, or decisions of official authorities, and other things that cannot be expected or cannot be paid. 7-2 (Business Meal) does not bear responsibility for damages that the user is exposed to when using our platform, such as viruses or malicious programs that do not result from negligence, gross negligence, or transgression on our part, nor does it bear responsibility for damages that are caused by a third party that is not related or not. We have no control over it, including - but not limited to - links and transfers that take place from our platform to other sites and programs whose contents and security we do not guarantee; Note that we at (Business Meal ) take all necessary measures to keep our platform as safe as possible. 7-3 Business Meal does not bear responsibility for the user’s misunderstanding, the user’s misuse of the service, or the user’s violation of any of the terms and conditions or any applicable law, regulation, decision, custom, or public morals, nor does it bear responsibility for the user’s infringement of any rights. It belongs to third parties, including its representatives. 7-4 (Business Meal ) does not bear responsibility for the incorrect data or contents of the products displayed and provided by the stores whose services are available on the (Business Meal ) platform, including whether they are free of foods or allergens, their type, nature, method of preparation, contents, and so on. Also, (Business Meal ) is not responsible for the lack of quality of the products or their failure to meet the user’s expectations, or for the failure of these stores or restaurants to follow the rules, regulations and decisions related to the provisions of the Ministry of Health and the Ministry of Municipal and Rural Affairs of Saudi Arabia and their equivalents in other countries where (Business Meal ) services are available. Meal ); All of this is the responsibility of the store and outside the authority and responsibility of (Business Meal ). 7.5 Business Meal does not bear responsibility for the results of the evaluation and the comments that users include therein, and for any losses that may occur or may occur as a result of them, nor does it bear responsibility for the recommendations that appear for any product or store to the user; These results and recommendations are the result of automated estimated or statistical data based on the information, opinions, or data collected from users. 7-6 Business Meal does not bear any infringements, violations, or violations of any law, regulation, decision, customs, or public morals committed by a natural or legal person over whom it has no authority or supervision and who is under the management, supervision, or authority of a third party. This includes - but is not limited to - what occurs and takes place in interactive services related to oral or written means of communication that are not directly supervised by (Business Meal ). 7.7 Business Meal , in general, does not bear responsibility for anything that is not the result of any infringement or negligence on its part. 7-8 Business Meal shall bear responsibility in the event of any failure or failure to implement the request to compensate the user in accordance with the provisions of Clause (12) of these terms and conditions. 8- User rights 8-1 Notifying the user of the fundamental amendments made to the terms and conditions and the privacy policy, and that these fundamental amendments shall not apply to him except one week after he is notified of them. 8-2 Providing the user with an electronic copy of his order invoice from (Business Meal ). 8-3 Inform the user if his request cannot be delivered. 8-4 The user’s right to commit to (Business Meal ) directing its representatives to implement all precautionary measures and preventive measures issued by official authorities. 8-5 Preserving the user’s personal data as much as possible by taking the necessary security procedures and measures, and not exploiting, using or sharing it for purposes other than the legitimate purposes stated in the terms and conditions or the privacy policy, and whatever happens therefrom. 8-6 Notifying the user when there is any breach of his personal data on the (Business Meal ) platform and databases, explaining its effects and the measures taken to address it, within (3) days from the date (Business Meal ) becomes aware of the breach. 8-7 The user has the right to hear, receive and address his complaints about what he is exposed to while using Business Meal services, in accordance with what is stated in Clause (14) of these terms and conditions. 8-8 The user who wishes to stop using the (Business Meal ) platform, and the processing and use of his personal data in accordance with what is stated in the terms and conditions and the privacy policy, must contact (Business Meal ) with a request to cancel his account. 9- Business Meal powers In addition to what is stated in the Terms and Conditions, Privacy Policy, and other policies - if any - that include powers owned by (Business Meal ), the user agrees and acknowledges his knowledge of the following powers of (Business Meal ): 9.1 To retain the user’s personal data, and all information collected from his use of the (Business Meal ) platform, whatever its nature or form; Without prejudice to the user’s privacy in accordance with the restrictions and powers stated in the privacy policy, and to continue doing so until the user contacts (Business Meal ) with a request to cancel the account. 9-2 To use the user’s personal data and his communication data to notify the user of any statement related to its services, provisions, policies, user requests or complaints, and other reasons. The user agrees to use his communication data to provide advertisements and marketing and promotional offers related to (Business Meal) services or in participating stores or displayed in them. 9-3 To process the user’s data and information - personal and non-personal - that are collected and what he uploads, sends or enters, and to use them for the purposes and services of (Business Meal ), and for the purposes of increasing its customers - whether users or stores - or to conduct any research related to any Whatever is stated in this clause, in accordance with the provisions of the privacy policy. 9.4 To dispose of any of the data and information - non-personal - that you collect from the user’s use of the application, regardless of its nature or type, including - but not limited to - his evaluation of stores, products and services, and the statistics that you collect from users’ use of the (Business Meal ) platform. ), and to reuse, sell, distribute, or transfer it, without any financial compensation to the user or third party; This must be done in a way that does not lead to the user being specifically identified. 9.5 To cancel, delete, suspend or block, temporarily or permanently, any user’s account at any time without notifying him; Whether due to the User's violation of the content or acceptable use standards, violation of any provision of the Terms and Conditions, or for any other reason in its absolute and sole discretion; With the right to prosecute the user and bear the resulting legal costs and attorney’s fees. 9-6 To delete, block or block any comments, words, posts or user input of any nature on the (Business Meal ) platform, whether for violating content standards or for any other reason, according to the will of (Business Meal ) and its absolute and sole discretion. 9-7 To stop its services or suspend the operation of its platform, in whole or in part, permanently or temporarily, for the purposes of maintenance, updating, development or modification, or for any other purpose or reason, according to its absolute will, at any time; This does not prejudice the right of the user whose service is being provided during this cessation or suspension to compensation in accordance with what is stated in Clause (12-4) of the terms and conditions. 9-8 To dispose of its property, or contract with others to implement its services; In this case, the successor is bound by these terms and conditions and the privacy policy, until he updates them and notifies the user of that. 10- How the Business Mail application works 10-1 The Business Meal platform allows the user to choose from any of the available stores that offer their services with us. It also provides a list of the products available in these stores, their description, prices, and user evaluation of them, in addition to various options of payment methods according to the user’s preference. It enables the user to track the order and communicate with the delivery representative. 10-2 The user can order from one of the stores displayed and available to him - depending on his location - by adding the products he desires from the list displayed in the store to the shopping cart. The user can also add a (special request) to the product according to his desire, by writing a note before adding the product. To the basket. 10-3 Once the user has finished selecting the products he desires from the list, he must go to (the basket or payment page), specify the exact delivery address, and the pickup time he prefers; Either at the earliest available time, or by scheduling an appointment through the (Schedule Order) feature by specifying the desired day and time for delivery. 10-4 The user must carefully review the request, invoice, and information he enters - from addresses, means of communication, appointments, or payment methods that he chooses from the available list before pressing “Send the request.” The contract is concluded as soon as the user presses “Send the request” and... The store accepts it. 10-5 (Business Meal ) is not obligated to accept the request after the user sends it, for any reason; In this case, the user will be compensated for the amounts he previously paid electronically. 10-6 If the user makes an error related to the data required to complete the order - without the platform allowing him to modify it - he may contact customer service at (Business Meal ) with a request to correct it according to the following: 10-6-1 If the order is specified for the earliest date, he must inform us of the location of the error in order to correct it - if possible and depending on the case - provided that the store has not begun preparing the user’s order during this period. 10-6-2 If the order is scheduled, he must inform us of the error in order to correct it at least 24 hours before the order is scheduled to be delivered; Provided that the store has not begun processing the user’s order during this period. 10-6-3 The user’s right to use his right mentioned in this clause shall lapse if the specified period has passed or if he benefits from the received product or service, or if he obtains any benefit from them. The beginning of processing the order or the representative receiving the order is, for example, but not limited to, taking advantage of the service provided by (Business Meal ). 10-6-4 Not every modification that the user wishes to make is considered an error that falls under the provisions of this clause; The estimate of the correctable error is up to Business Meal in accordance with the provisions of this clause, then according to the reality of the situation and the possibility of correction. To contact customer service at (Business Meal ) to inform us of the location of the error as soon as possible to correct it - in this case, the store must not have begun processing the user’s order. 10-8 We may correct an unintended error in the statement or offer presented or apparent to the user, provided that we contact the user regarding this and inform him of the error as soon as we learn of it and before starting to prepare the order, before receiving the order, or before delivering it to the user; In this case, the user has the choice between continuing to implement his request after correction or canceling it and compensating him for what resulted from this error without the rest. 10-9 The delivery representative’s termination of the order is considered a completion of the service and a presumption that the user has received his order. The user whose order was completed before he received the order must file a complaint within (10) minutes from the time the delivery representative finishes the order, according to what is stated in Clause (12-5). ) of the terms and conditions. 10-10 The user shall bear any amounts imposed by the store in excess of what is stated in the invoice as a result of adding any note or special request to the product. 10-11 All data and details displayed in stores and their lists are the responsibility of the store that provided (Business Meal ) with them, and we do not guarantee their accuracy, and it is the responsibility of the user to verify the details from the store directly in accordance with what is stated in clause (6-5) of the terms and conditions. 11. Canceling and tripping the order 11-1 The user has the right to cancel his submitted order provided that the store has not started processing the user’s order, without any financial fees being imposed. 11-2 If the user wishes to cancel his order after the store has begun preparing his order, he is obligated to pay all financial costs incurred by the order. 11-3 If the user submits a scheduled order using the (Schedule Order) feature, he may contact customer service via the (Get Help) feature to cancel the order before starting to prepare it. Otherwise, the provisions of clause (11-2) above will apply to cancellation. 11-4 In the event that the user does not receive the order due to his refusal to receive it despite accessing the site entered by him, he is considered to be one who canceled the order after accepting and preparing it, and the provisions of clause (11-2) above apply to him. 11-5 In the event that the user is unable to reach him because he entered wrong addresses or means of communication, or because he did not remain in contact after sending the request, he is given (30) minutes from the time the representative arrives at the location specified by the user; If this period expires without him responding to the representative, without communicating with him or with customer service, or without him receiving the order, his order will be terminated, and Business Meal will no longer be obligated to deliver the order to him or compensate him for it in any way, due to his violation of clauses (6-2). And (6-3) of the terms and conditions. 11-6 (Business Meal ) does not provide an exchange or return service for any of the products that the user requests/receives - regardless of the nature of the product - and the store’s return policies apply to him, which are beyond our authority, and he must communicate this with the store that owns the product directly. 12- Compensation 12-1 The user who has damaged or missing a product he ordered, or received a product different from the one he ordered, will be compensated by one of two means: 12-1-1 Trying to deliver the same product that the user requested, or a product similar to it - according to the agreement, taking into account the price difference -. 12-1-2 Compensating the user with the value of the missing or damaged product or with the value of the correct product. 12-2 The user is entitled to compensation in the event that the product he requested is not available in the store, by being compensated for the value of the product; This is if the product has been paid for electronically before receipt. 12-3 If the delivery of his order is delayed, the user is entitled to be compensated with the value of the delivery, based on a complaint he submits; The order is considered late if it exceeds (60) minutes after the scheduled delivery time. And compensation. 12-6 The provisions of force majeure mentioned in clause (7-1) of the terms and conditions shall be taken into account as stated in this clause. 12-7 Compensation is made by depositing the amount in the user’s account wallet on the Business Meal platform, or by a money transfer deposited in his bank account, which he provides customer service with at his own risk. 12-8 The process of depositing the amount into the user’s bank account may take a period of 7 to 14 working days from the time the user’s complaint is processed and his compensation is approved. In the event of any delay, the user must contact us to clarify any ambiguity, and provide him with a copy of the refund notice - if he requests it. - To follow up with the bank. 13- Evaluation 13-1 After the end of the service provided to the user, the user can be asked to evaluate the store with which he dealt, and he can also be asked to evaluate the representative and the (Business Meal ) services. 13-2 Only the actual service user should conduct the evaluation. 13-3 The user’s evaluation of (Business Meal ) services, its representatives, stores and products must be fair, honest, true and correct to the extent possible, and he must not use it for the purpose of abuse, disparagement, misleading or manipulation in any way, whether negative or positive. 13-4 The content standards and prohibitions contained in Clause (5) apply to what the user enters and includes in the evaluation, and the provisions of Clause (9-6) also apply to the user evaluation. 13.5 (Business Meal ) has the right to stop, suspend or prevent the evaluation, temporarily or permanently, for all, some or any of the users, for any reason, according to its absolute discretion. 14- Complaints and suggestions 14-1 The user has the right to submit any comment, whether a suggestion, a complaint, or anything else, when he is exposed to something that calls for it while using (Business Meal). 14-2 The user can submit his note by contacting (Business Meal) customer service by clicking on the (Contact Us) feature on the (Business Meal) platform, choosing the type of note from the list, and explaining what he has as an accurate description; The user may be contacted directly by calling the Business Meal customer service team, and these calls may also be recorded for the purposes of controlling the quality of the user’s service. 14-3 We at (Business Meal) always strive to satisfy users, and we promise to listen to the user’s suggestions and inquiries as much as possible. We will address the complaints submitted by the user by investigating them within two days from the date of their registration, and compensating him when one of the cases mentioned in Clause (12) is fulfilled. From the terms and conditions, the user can follow up on his restricted complaint and its outcome via the (Get help) feature on our platform. 14-4 The provisions of the content standards contained in Clause (5) of the Terms and Conditions apply to the user’s communication with (Business Meal) customer service via any means of communication that allows the user to reach us. 15- Save data (Business Meal) collects, saves, protects and processes user data and information throughout its use of our services and having an account with it.
